Defused, LLC - Terms & Conditions / Master Service Agreement (MSA)

Welcome to Defused, a Honeypot-as-a-Service platform operated by Defused, LLC ("Defused," "we," "our," or "us").

By subscribing to, accessing, or using any Defused product, service, data feed, or dashboard (collectively, the "Services"), you ("Customer," "you," or "your") agree to be bound by this Master Service Agreement and Terms & Conditions.

This agreement governs all subscriptions, trials, and use of the Defused platform. If you do not agree, please do not use our Services.

1. Master Service Agreement (MSA) / Statement of Work (SOW)

1.1 What You’re Purchasing

Defused provides managed honeypot infrastructure and threat data feeds designed to help customers observe and analyze live exploitation attempts and attack telemetry.

Depending on your subscription tier, you are purchasing one or more of the following deliverables:

  • Managed Honeypots:
    Defused deploys, maintains, and monitors honeypot instances on your behalf. These instances capture exploit attempts, payloads, and network metadata for aggregation and analysis.
  • Exploit Data Feeds:
    You receive structured access to captured data through dashboards, APIs, or scheduled reports. Data may include exploit identifiers, payload samples, source IPs, timestamps, and related threat context.
  • Self-Hosted Deployment (where applicable):
    Certain plans allow you to host honeypot sensors in your own environment. These sensors must remain connected to Defused’s backend to ensure telemetry collection and system integrity.

1.2 Guaranteed Deliverables

For each active, paid subscription period, Defused guarantees delivery of:

  1. Access to your subscribed data feed(s) for the duration of your paid term.
  2. At least one functional honeypot (if included in your plan) monitored by Defused.
  3. Access to your customer dashboard or portal.

If Defused fails to provide these core deliverables and cannot remedy the issue within 10 business days of written notice, you may request a refund for that billing period. Otherwise, all sales are final.

1.3 Service Level

Defused maintains best-effort uptime and monitoring but does not guarantee uninterrupted service due to the experimental and dynamic nature of cyber deception systems.

1.4 Ownership of Honeypot Data

All telemetry, exploit samples, logs, payloads, and associated data ("Honeypot Data") collected via the Defused platform-whether from Defused-hosted or customer-hosted sensors-are the exclusive property of Defused, LLC.

You receive a license to access and view relevant data through your subscription, but you do not gain ownership, transfer, or resale rights.

Any resale, redistribution, or sublicensing of Defused data or analytics is granted via a separate written agreement with Defused, LLC.

Defused may use, process, aggregate, and commercialize this data at its discretion for research, intelligence sharing, or product development. We always handle data responsibly and without identifying individuals or organizations unless required by law.

2. Billing Policy

2.1 Payment Terms

All payments are securely processed through Stripe. You authorize Defused, LLC to automatically charge your selected payment method on a recurring basis (monthly or annually, as chosen).

By subscribing, you agree that:

  • Billing begins immediately upon plan activation.
  • Renewal charges will occur automatically at the start of each new billing cycle.

2.2 Refunds

All purchases are final. Refunds are only issued if Defused fails to deliver the guaranteed deliverables listed in Section 1.2.

2.3 Credits

In the event of extended outages (greater than 48 consecutive hours), Defused may, at its sole discretion, issue account credits applicable to future billing cycles.

2.4 Disputes

By accepting these Terms, you agree to:

  • Contact Defused at simo@defusedcyber.com to resolve any billing concern before filing a chargeback.
  • Not initiate payment disputes for services delivered in accordance with Section 1.2.
  • Understand that chargebacks filed without prior contact constitute a breach of these Terms.

This clear policy ensures transparent handling and helps prevent misuse of the chargeback process. Stripe typically honors these terms when published and acknowledged by customers.

3. Terms & Conditions

3.1 Acceptable Use

You agree not to:

  • Use Defused honeypots for offensive testing or unauthorized network activity.
  • Attempt to interfere with or gain unauthorized access to Defused systems.
  • Share, resell, or redistribute Defused data feeds or dashboards without written consent.
  • Reverse-engineer, modify, or attempt to clone Defused’s software, sensors, or backend systems.

3.2 Confidentiality

Defused treats all customer credentials, configurations, and internal data as confidential. You agree to treat all non-public aspects of Defused’s systems and operations as confidential as well.

3.3 Limitation of Liability

Defused’s total liability for any claim arising out of or relating to the Services is limited to the total amount you paid to Defused in the three (3) months preceding the claim. Defused is not liable for indirect, incidental, or consequential damages, including data loss or business interruption.

3.4 Termination

You may cancel your subscription at any time prior to the next billing cycle. Defused may suspend or terminate accounts for non-payment, abuse, or violation of these Terms. Upon termination, your access to the Services will cease, but Defused retains ownership of all collected data.

3.5 Public Display

These Terms & Conditions constitute a binding Master Service Agreement between you and Defused, LLC. By subscribing or using the Services, you acknowledge that you have read, understood, and agreed to this agreement in full.

Defused provides honeypot and cyber deception services for defensive and research purposes only. By using our Services, you agree that all activity and data captured through our systems are analyzed and retained by Defused, LLC in accordance with these Terms.
